PROEM & POEM No. 66 - Individualism versus Constitutionalism / 5th Reprise

      There should be no confusion, while a social, political system is ethical solely by unanimous consent, its sustainability is quite another matter. To say differently, if a social, political arrangement proves to be unsustainable in the short or long term, it remains ethical as so long each and every individual consents. Comparable to individual(s) choosing self-destructive even suicidal actions, there is no ethical dilemma, rather a question of perceived benefits versus detriments. With that said, some writers (i.e. Henry Hazlitt as one) have rightly pointed out the moral consideration raised when any action or arrangement consistently proves detrimental to property, liberty and life itself. Although, however harmful or horrific, as long unanimous consent persists, so be it.

      Unsurprisingly, there has yet been a modern governmental union of any sort, when on the decline economically allow dissenting parties, factions, groups or individuals to secede or depart without taxational, judicial and forceful (police/military) retaliation. The empire United States, as one example, formed with the appearance of consent by the people thus voluntary admission to the political union, only to later disallow violently those dissenting thus desiring to leave or separate. In such dire scenarios, seemingly a mere remnant will discern the disrespect and disregard for the Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent, fewer still foresee mid the early stages of the digression.

PROEM & POEM No. 65 - Individualism versus Constitutionalism / 4th Reprise


      Though perhaps redundant (to No. 64), it is worth referring to commonly esteemed at times popularly revered documents, books and essays as well some respected by this writer/poet. Consequently, to consider a select few among many historically;  the Hammurabi or Gortyn codes, Ten Commandments, Taoist proverbs or any other socio-religious statutes, Magna Carta Libertatum or U.S. Constitution, Bill of Rights and preceding Articles of Confederation, as well Plato’s Republic, Rousseau’s Social Contract, Locke’s Two Treatises of Government, Marx/Engels’ pamphlet Communist Manifesto, Keynes’ Treatise on Money, Hitler’s Mein Kampf, Stalin’s Foundations of Leninism and some personally preferred like Hayek’s Constitution of Liberty, Hazlitt’s Foundation of Morality even Bastiat’s intriguing essay The Law and Mises’ insightful books Classical Liberalism or Human Action, and much more similarly on topics political, societal, economics; all are tolerable, agreeable, desirable therefore justifiable as far as unanimous consent accepts and allows to socially, politically implement for the ethical forming of societies of two, two-dozen, two-hundred, two-thousand, two-million or more.

      Conversely, if imposed by the dictates of a despotic one/few, oligarchic minority or democratic majority, then the very same aforementioned arrangements must be judged as unethical hence rejected, else the disrespect and disregard of the Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent.

PROEM & POEM No. 64 - Individualism versus Constitutionalism / 3rd Reprise


      Redundant though necessary it is paramount to reemphasize alternatively and lastly. When scrutinizing constitutions, governing documents, social contracts or charters, as well the near endless books and essays on such things, all are only as ethically noteworthy for implementation if unanimously consented at formation and duration of a society and government. The justification (or ethic) must be founded on nothing less than a fanatical resolve to respect and regard each and every individual’s Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent.

      For what is the justification (as inquired in No.3) of any arrangement intimate, private, philosophical, spiritual, theological, public, social or political between two persons or more if not Consent expressed by each individual? To go further, what is the justification of any arrangement between two dozen, two hundred, two thousand, two million or more people if not Consent expressed initially and continuously by literally all individuals? Else without consent unanimous, quite meaningless are any lofty notions of liberty or freedom, social justice, even citizen or human rights whether numbering 3, 4, 10 or 30 (as discussed in No. 27 and 28).

PROEM & POEM No. 63 - Individualism versus Constitutionalism / 2nd Reprise


  Thirdly, if constitutions or any other political arrangements fail to garner unanimous consent initially and continuously, all individuals involved and effected must be allowed to reconsider, rearrange (modify or not) then reaffirm them, else those consenting remain (or not) while those dissenting depart (or not), or dissolve so each and every individual may pursue other social preferences. Otherwise, unethically often monstrously disrespected and disregarded are the Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent.

  Fourthly, constitutionalists and their definitions are confused and muddled, having lost their way if you will, squabbling per arbitrary reverences for one historical document over another. Again, with unanimous consent all are tolerable, agreeable even desirable, without unanimous consent all are undesirable, disagreeable even intolerable. With that said, there is only one logically effective purpose for constitutions in order to preserve Individualism; to govern not society but government, to constrain not citizens but politicians, to preserve  and perpetuate individual sovereignty not political authority. In this way, bills or lists of rights are unnecessary, if strictly prohibited all unstated political arrangements or governmental powers as previously concluded “whatever is not written, is not allowed” (see No. 21).

PROEM & POEM No. 62 - Individualism versus Constitutionalism / 1st Reprise


      Firstly, constitutions must be nothing other than concisely enumerated governmental powers, justified solely by unanimous consent, that is, consent by each and every individual, therefore all forgoing tolerably or agreeably the effected personal liberties. It is simply a power exchange, quite similar to the economizing thus reasoning between seller and buyer, hence ethical only if unanimously consented for the political barter, initially and continuously accepted among all involved parties else unethical as well tyrannical.

      Secondly, it is important to emphasize two unavoidable, ethical dilemmas regarding constitutions or any other governmental order, policy, law, tax, program, action, etc. Without unanimous consent initially, political arrangements cannot ethically commence. Without unanimous consent continuously, political arrangements cannot ethically maintain. If commenced and maintained without unanimous consent, political arrangements cannot be without disrespecting and disregarding the Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent, of at least one if not a few, some or most.

PROEM & POEM No. 61 - Individualism versus Constitutionalism


      Most if not all (minus very few) academic definitions of Constitutionalism thus most if not all (minus very few) accepted purposes for a Constitution have unquestionably enabled creative political minds to molest thus reduce even completely eliminate Individualism. These creatively perverse motives of course are never published on paper or proposed o’er podiums, rather intentionally propagandized as constructive, beneficial, necessary, expedient, positive, good even moral per some higher authority specific or vague (i.e. the common “it just feels right” or alleged singular “will of the people). Interestingly odd, the same propaganda will often be genuinely held, though illogically formulated contrary to empirical evidences, also per some higher authority specific or vague.

      With that said, purposeful or not, constitutions’ usual complexities therefore resultant inconsistencies have always perpetuated the Individual’s digression and demise from initiation to escalation as well mere continuation of skillfully crafted to bombastically advanced disrespect and disregard for the Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent.

PROEM & POEM No. 60 - Individualism versus Aforementioned Isms


      Given the previous installment (No. 59), distinctions are noteworthy. Isms such as Communism, Fascism, Cronyism and Americanism are first and foremost poli-economic systems, constantly power-brokering towards control of the economy. Upon total control, the two modes of power-brokering do not stop but continue to sustain and maintain the economic control; threat of loss and/or promise of gain, irreversibly bartering off Individualism. To explain further, the threat of loss may be fine, license/application fee, tax, confiscation, regulation, ban, embargo, sanction, incarceration, execution, invasion, occupation, annihilation and more; categorically brutish Kratocracism cloaked as forms of paternalistic and/or broadly elitist Interventionism. Meanwhile, promise of gain may be loan, grant, subsidy, welfare, healthcare, retirement, housing, transportation, recreation, aide, trade agreement, peace treaty, contract, employment and more; categorically brutish Kratocracism sheep-clothed as empathetic Socialism.

       Politics or poli-economics are nothing more than power-brokering, the transfer of person, power and possession from individual control to government control, always lacking unanimous support, therefore always disrespecting and disregarding the Peculiar Human Ability to Reason, inseparably the Singular Human Right to Consent or Not Consent.
